Many of you reached out to us via Twitter last night and today regarding a situation a Customer Twittered about that occurred on a Southwest flight.  It is not our customary method of Customer Relations to be so public in how we work through these situations, but with so many people involved in the occurrence, you also should be involved in the solution. First and foremost, to Mr. Smith; we would like to echo our Tweets and again offer our heartfelt apologies to you.   We are sincerely sorry for your travel experience on Southwest Airlines. 

As soon as we saw the first Tweet from Mr. Smith, we contacted him personally to apologize for his experience and to address his concerns on both Twitter and with a personal phone call. Since the situation has received a lot of public attention, we'd like to take the opportunity to address a few of the specifics here as well.

Mr. Smith originally purchased two Southwest seats on a flight from Oakland to Burbank – as he’s been known to do when traveling on Southwest.  He decided to change his plans and board an earlier flight to Burbank, which technically means flying standby. As you may know, airlines are not able to clear standby passengers until all Customers are boarded. When the time came to board Mr. Smith, we had only a single seat available for him to occupy. We are responsible for the Safety and comfort of all Customers on the aircraft and therefore, we made a judgment call that Mr. Smith needed more than one seat to complete his flight. Our Employees explained why the decision was made, accommodated Mr. Smith on a later flight, and issued him a $100 Southwest travel voucher for his inconvenience.

You've read about these situations before. Southwest instituted our Customer of Size policy more than 25 years ago. The policy requires passengers that can not fit safely and comfortably in one seat to purchase an additional seat while traveling. This policy is not unique to Southwest Airlines and it is not a revenue generator. Most, if not all, carriers have similar policies, but unique to Southwest is the refunding of the second seat purchased (if the flight does not oversell) which is greater than any revenue made (full policy can be found here). The spirit of this policy is based solely on Customer comfort and Safety. As a Company committed to serving our Customers in Safety and comfort, we feel the definitive boundary between seats is the armrest. If a Customer cannot comfortably lower the armrest and infringes on a portion of another seat, a Customer seated adjacent would be very uncomfortable and a timely exit from the aircraft in the event of an emergency might be compromised if we allow a cramped, restricted seating arrangement.

Sorry, the captain made a mistake here. I admit that it is not pleasant to sit next to an obese person on a plane. But it is wrong to make smart remarks like "Fatties should put down their forks." Science has proven that diet and exercise are not always the answer for fat people. Hell, Weight Watchers even says "Diets don't work" in their advertising. Like it or not, obesity is more prevalent than ever. Michelle Obama has recently made the issue of childhood obesity one of her causes. I wish her luck with this, Michelle will need it. Obesity may be here to stay, but if Southwest and their competitors keep up the prejudice against overweight passengers, the airlines won't be with us much longer. Air travel has declined since 9/11. Lots of airlines have gone bankrupt. As I said, fat passengers aren't always pleasant. But they're a hell of a lot more desirable than going out of business.

THANK YOU, SWA!!!! I have been wedged into too many tight areas because the slob next me didn't purchase enough seats to contain his oversized body. Yeah, it's about safety, but even more importantly, it's about taking care of the other customers who are being violated. I will continue to fly with an airline that stands up for MY rights. Way to go, SWA!!! (And, no... I am definitely not an employee. I hate the fact that you can't reserve a seat on their flights.)

Wow... To post such a lame excuse for an apology... You as a company (SouthWest), Are seriously in need of leadership that can take you somewhere other than the hole you are existing in. And yes, you are in a hole.

I don't think Kevin Smith deserved an apology from Southwest. If he has so little self control, he needs to rethink how he lives his life. I do not enjoy traveling on an airplane if I am forced to sit beside a fat person. They occupy some of my personal space because of how big they are. Keep your policy like it was Southwest, and don't apologize when you don't have to!!

Yeah, so I'm a fat girl and I'm supposed to be flying Southwest in about a week... Now I'm afraid that turning up at the airport is going to be an exercise in humiliation. I can barely aford to buy one ticket - there is no chance I would be able to afford a second one at the last minute. I have no idea what I will do if this happens to me. I'm already sorry I chose Southwest (with whom I've flown in the past with out any trouble) due to the treatment of Kevin Smith and his observed treatment of other passengers of size. From now on, my flights will be with Canadian carriers… the Supreme Court of Canada and the Canadian Transportation Agency have made it illegal for airlines to charge fat people for two seats… one-person-one-fare sounds fair to me. http://www.reuters.com/article/idUSN2039776920081120

You point would be valid if he hadn't flown on other flights from SW with no problems. He caught a later flight, with no problems, not having been required to buy two seats.

Kevin Smith is usually spot on about things, but the reality is none of us were there, so we can't say for sure what is or isn't the truth. In the end, the employee have a job to do and policies to follow, which they did. Smith as a customer has a right to complain if he feels slighted, which he did. And that's really all there is to be done about it.

How many times does this happen a day on EVERY airline? Dozens I'm sure, but because the overweight person is somewhat famous we have publicity. The airline has a policy in place for everyone's safety including Mr. Smith. He knows he's overweight and that is why he buys two tickets, so why make a big fuss about it. ..because he wants publicity for his upcoming film. Don't back down Southwest for our safety.

If southwest was so concerned about comfort and Safety wouldn't they put in slightly larger seats with more leg room. I am skinny but tall if i had the middle seat the person next to me wouldn't be able to get out of their seat and if i was in the front row like MR Smith people would be tripping over me, but I have never been told I am a safety issue.........Oh wait is this really just a money issue? Forget you Southwest I am now just flying Jet Blue, they have more leg room.

Okay all of the people saying he is doing this because he wants publicity honestly ask yourselves if he wasnt famous and he made a fuss wouldnt you just say oh hes a nobody seeking his 15 minutes of fame thats the way americans seem to be say either its a celebraty seeking publicity or a nobody wanting there spotlight time sometimes people just have to realise not everything is about fame/publicity

Kevin Smith is THAT fat. Quite franky I don't think we should accommodate people who are more obese than they have any right to be. You should have a look into the added medical expenses of hospitals having to deal with people who are overweight.

Really southwest... You guys have a problem being a larger person my self i have to say the way you went about treating Kevin was completely wrong and uncalled for. As for me i fly my company on business trips with your airline and i will be taking my business to american airlines now because you dont know how to treat a customer. One of the other posters made this post " Let me ask about these policies: Do you require elderly who cannot move as fast, use a cane or require wheelchair assistance to bring along help for safety reasons so that they don't slow down the exiting process in case of emergency? Do you charge them extra for the ability to use a wheelchair and get assistance from the airline crew? Do you require someone who is wearing a cast on his/her leg to purchase an extra seat for the comfort and safety of others? Do you allow people with mental disabilities who might be confused in an emergency situation to fly on your airline? Do you allow unaccompanied minors who cannot be expected to act in the same manor as an adult in an emergency situation to fly your airline? Furthermore, do you wait until these people have boarded and then publicly-humiliate them for their differences?" I could not of said it any better my self. I think it is like Kevin said the guy on the jetway was just made cause he did not think Kevin was funny.

This policy is disgusting to me. How dare you humiliate a person simply due to their size? I'm proud of Kevin for calling foul on this, Southwest you are pathetic and with any luck, you will lose a TON of money from being disrespectful and callous to the customers that pay your bills. I will NEVER fly Southwest as long as I live.

It's less about size and more about those who discriminate. The employees need to be better educated about these so called rules. Because whether it's about size, color, religion, etc., Mark, the employee in TX may have common sense and therefore you get through but Susie, the employee in Idaho has no common sense and won't let you on no matter what. The so called rule is wrong PERIOD (my opinion), but if you're going to have it...then teach your employees how to deal with it or continue to get publicity that you supposedly don't want. You know, Southwest really doesn't care. They only say they are "sorry" when it becomes public. What about all those who have been and ARE being discriminated against who don't have twitter or are not famous, etc.? This happens more than you think, we just don't get to hear about it. Those who don't have to fly Southwest shouldn't. Those who don't have a better option should continue to make their voices heard because they are not going to care until you do. Corny, I know, but it's fact. (wonders if they are into censorship as well)

So he's fat and needs two seats. Why should Southwest - or anyone - have to pretend he's not? Just to spare his feelings? Southwest is an airline, not a counseling facility. If you need two seats, you need two seats. And if you people don't remember the crap he has made us digest in his disgusting movies, maybe you should watch one as a refresher. I'd rather be told I was fat than have to endure the filth he has put moviegoers through. He's not innocent, the guy. Why coddle him?

Just sick over this...I am a person of size and due to fly SWA next week with my 16 year old daughter. I've never needed 2 seats, I've always fit between the armrests, but I've never flown SWA before. So suddenly I am stressed to the max over being publicly humiliated on board with my daughter. So if I spill into a seat that I've already paid for will we both be removed from the flight? I want a refund...of course I can't get one. I've already called and asked. I was told that I could cancel my flight for full credit. NO...the point is I don't want to do business with this company. I've never been so nervous about flying in my life. Guaranteed my family will never fly with Southwest again!!

Lets all be honest NO ONE WANTS TO SIT NEXT TO A FAT PERSON..... us skinny people that stay in shape, and eat right shouldnt have to suffer hours of flight sitting next to a fat person whos fat rolls droop into ur personal space, And getting up to go to the restroom FORGET ABOUT IT !!!!! Once again this is a reason ill always fly SWA and belive me other airlines companys dont enforce the fat rule (cough, cough US Air and United). I think its funny all the fat people are out raged and up in arms this happened. Listen go to the gym, eat right, and ull never have this problem.

Southwest, only enforces (from my experiance).. rules for the safety and, FAA rules, I have gotten MUSHED between Two Large, passagers That flight Sucked,, All I can say is Jenny Craig,.. Good for southwest, And The piolt That is held responsable for the safty AND comfort of The passangers and crew! If he's so damn Important fly First class on another ailine where they have Big Boy seats Not Big Fat Cheap seats.. JW

So, Southwest won't let people with short skirts fly, they won't let people who fit in seats fly if they are "fluffy'.. But they're having fun and not charging for bags? Did I get that right? Wait, wait, will by bag still fly for free if it's too fat/big/stuffed? Can't wait to see the movie Kev makes out of this.

I'm a rather tiny person and have nothing against oversized people. But find it completely obsurd when I sit next to a larger person who takes one look at me and lifts up the armrest to further his own comfort! If I did that to someone simply cause I wanted to put my legs up on the seat it would be considered rude! Just as I consider it rude for someone to assume they are entitled to part of my seat because I do not occupy the whole thing! I wish more pilots and flight attendants were as observant of the situation, cause I would of had alot more comfortable flights!! And yes if I was seated next to Kevin Smith I would of probably shut my mouth, but that doesn't mean I would still want to give up part of my seat for him!

Get real people and Kudo's to SouthWest - Finally an airlines enforcing their own policy. These Fatso's need to keep their fat asses in their own seat. It is a safety issue, in the event of an emergency, I don't need some Hungry Hungry Hippo in my way. There should be a trial seat outside the boarding door. You don't fit - you don't fly. There should also be a method on-line when you are booking travel. You "Persons Of Size" know you are fat. You should be able to book a Person of Size seat then - and yes - pay more.

You guys failed to mention that he was seated with the armrests down and seatbelt buckled sans extender. You also failed to mention the other fatty that was sitting next to him on the next flight where he had 2 seats that she could have spilled over into if needed. Don't worry, he told us all about it! Good to know you guys get a kick out of regularly humiliating your customers! I used to fly SW 2x a month and always buy 2 seats, but due to your sizest bullshit I'll be taking my money and my butt shelf elsewhere. I don't even mind paying more for my seats. Just as long as I'm not supporting a sizest institution like yours. I hope this whole ordeal puts you out of business. BTW, would your CEO Herb Kelleher also be booted from a Southwest flight for being "a safety concern?" Hmmm.

Per the official SW comment - "a timely exit from the aircraft in the event of an emergency might be compromised if we allow a cramped, restricted seating arrangement." If every seat was occupied by people weighing 80 pounds, the flight would still be "cramped" and "restricted" due to the layout of the seating.

I guess what bothers me most about these negative posters is the assumption that all large people travel alone. As if we were a "nothing" in society. I've flown alone once to conference. Every other time I've been with my husband, children and friends. All who love me just the way I am. I only encroach on those that don't mind. When I flew alone I purposely chose my seat the night before in an empty row. The next time I sit across from the "talker", I'm writing to the airline to complain they were encroaching on my silent space!

It amazes me how uneducated some of the answers are here. And also how obvious it is that some who have posted were paid to do so. Kevin Smith is an average American, bottom line. I have seen much fatter people on flights left alone. I am not a small guy but I am by no means fat. 6 foot 230lbs. average American. Southwest had no right in this situation to do what they did. The moment the armrests were down and the seat belt was on they should have apologized immediately. Not to say they shouldnt have as soon as he stated who he was but that should have been for anyone that was discriminated in this manner. Southwest is freakin' ghetto. Last time I flied to Las Vegas they were being all "wacky" and one of the male flight attendants was wearing boxers on his head. Makes me think the pilots are doing tequila shots and the plane is ready to go down. Try professionalism, KS was right about Southwest being the Greyhound of the sky.

He could have buckled himself in given a chance. But, no. Not given a chance. I'm nice and slim myself, and will never have to worry about this issue personally. YET STILL, I will never fly Southwest again in my life. Congratulations. Your customers are human beings, not numbers. It's easy to forget that from the other side of a computer screen. If you want to maintain your customer base, you might want to remember that.

I got stuck next to a guy who poked his elbows into my ribs the entire flight and even though the arm rest was down, was all over my personal space. Not one flight attendant said a word to the gentleman who was clearly taking up WAY more than just his seat. Oh, and did I mention that he was no where near a "person of size"? He was just a jerk. My point is that if SW is going to have rules about this, they need to be clear, well known and evenly enforced. In Mr Smith's case, you missed on all three points.

the refunding of the second seat purchased (if the flight does not oversell) Ok, I've re-read this portion a half dozen times, and I'm still getting "We will refund you your purchase if we feel like it." Because surely you do not believe that whether a Flight oversells is within the Customer's Control? I wasn't on the Flight with Kevin Smith. I don't know if the Armrests were up or down, if he was infringing on another Customer's Space more than Mr. I'm-an-Important-Businessman-I-get-the-Armrests' Elbows do, or if someone on that particular Flight just has Issues with Customers of Size -- or with Kevin Smith. But ultimately, it doesn't matter. Your Customer of Size Policy does not affect me. Your Customer Service does. I had been pricing Flights for an upcoming Trip, and your 'wanna get away' Prices were certainly attractive, but I had concerns about the Restrictions. It was unclear to me what might happen if Circumstances beyond my Control prevented a connecting Flight from leaving as scheduled resulting in a missed Connection. Thank you for removing the Temptation!

Not only was your crew insensitive at the time to Mr. Smith, your reaction and response was even more so. Your official statement on it and "apology" are insulting and inadequate. I will not use Southwest in the future and will not recommend it to others.

Good for you Southwest! You have a policy and stood by it, without regard to someone's job title or position in life! Kevin Smith is acting like a over weight whinner. Had he just spent the money that he used to buy those second seats for himself all these years on a treadmill instead, he wouldn't be having this problem. Besides, you kindly offered to give him a $100 voucher after he was already declared a safety risk. He should have been reported to the DHS for the danger that he posed to the other passengers! Thank you Southwest for protecting me against terrorists like Kevin Smith! I'll fly you as much as I can now!

Kind of awesome how you're trying to spin this like it's his fault and he should have known better. Especially when he demonstrated his ability to operate his arm rests which is the test that qualifies someone as a "customer of size." How about "we want to extort people who could potentially be too big to fit in a single seat, so we'll dance around the issue and claim that there's a safety issue and then demand that they purchase a second ticket." Interesting that the two most notable stories of this happening to people are on RETURN flights, when they're desperate to get back home... Especially since both people (Kevin and Natalie) had flown Multiple times in the past few months on Southwest without incident... Sounds like a way to coerce paying customers to pay more on flights to me. I totally agree that fat people taking up room in other seats isn't fair to other customers who are paying for their whole seat... but if you're going to make up a rule to prevent this how about trying to enforce it in situations where it makes sense. Also if you can't point to a solid reason why someone qualifies as a "customer of size" it sounds like you haven't thought this through. This type of mismanagement is why the airlines have been struggling for years. Put simply, airlines suck at making common sense decisions. Now it seams Southwest is the king of the idiots.

i'd like to formally apologize to southwest airlines for endangering their aircraft & the lives of all the passengers by threatening to occupy a single seat when two seats are clearly needed to accomodate my gargantuous bottom, for purposes of safety, in order to avoid tipping over the aircraft in flight. once again i sincerely apologize, & would like to re-emphasize the fact that southwest airlines will remain my airline of choice, indefinately.

I commend Southwest for taking everyones' comfort into consideration. I can't wait until SWA incorporate some new rules for further comfort. I can't stand sitting next to retards, coloured folks, people with annoying voices, smelly people, or children. Southwest ought to take a big giant step forward and segregate everyone by a detailed checklist of individual characteristics. Hell, we can have a separate plane for blacks, jews, fatties, stinky people, gays, old, and the young. Hating everyone, I don't feel the current policies are encompassing enough. Take my comfort into consideration; segregate further. There are other demographics who deserve to pay twice the standard fare. Get 'em good. Discomfort taxation for all!

Great job Southwest! You are now my favorite airline. Don't be bothered by the negative comments here. The Fat Acceptance blogs are going crazy and linking to this site which is weighting the comments to the fatties (pardon the pun). The US is the fattest country in the world. It's not genetics...unless our genes have transformed in 200 years as most europeans are still thin due to lower portions and more exercise.

Let's be honest..... Kevin Smith is morbidly obese. Through no fault of anyone but himself he has grown to a size where seats that can safely and comfortably accommodate 90% of the population are now inadequate for accommodating him. It is unfortunate that the issue had to be raised in such a manner but clearly Mr. Smith knew it was an issue as he typically buys two seats for his own use. Seriously, do you think they want to tell someone they're too fat for one seat?? You think they wanted to embarrass him? You think they wanted to delay the departure of the flight?? A reasonable person would realize that the answer to these questions is NO. They all just want to do their jobs correctly and with as little stress as possible JUST LIKE EVERYONE ELSE. I bartend. Do you think I enjoy telling people who have had too much to drink or are underage to get out?? Of course not. I would prefer if my night went by stress free and without confrontation but sometimes it is in my job description to intervene. Cut SWA some slack. They acted because they felt they had to. In one of those little ironies of life, I booked my first Southwest flight over the weekend before finding out that customers' appearance must be approved by the airline or they can't fly. I'm not certain how to proceed now. There was no scale available when I booked the flight. Will I have to weigh-in in front of everyone before the flight? I DO need to lose about 15 pounds, so I'm just not sure if I meet the SW supermodel standards.

Thank you Kevin I am wheelchair bound and have gained weight because of it. It isn't easy for me to fly, but I hadn't seen my son for 3 years. I drove 4 hrs so I could take southwest (my x favorite airline). they have always been so kind to me, until my last trip. I arrived at the airport exhausted. I went thru customs, which because of my handicap was harrowing. I boarded the plane, my wheelchair was with the baggage in the belly of the plane and with a sigh of relief I was on my way. All the passengers boarded and one passenger had asked if the plane was full, it was not. It had 12 empty seats. This dude boarded the plane and asked if I had purchased two tickets. I said no. He said it was necessary...I didn't know what to do. Unlike you I was so embarrassed I kept my dignity until I exited the plane and then went to the restroom and cried my eyes out. Went to my van and realized I didn't have my luggage. It went to Boise with all my meds. I didn't get my luggage for a week. I haven't told you the whole story of how I was treated, but I drove home upset all the way. I was a chicken....I didn't make waves and I should have. Thanks for representing all of us. Each person is an individual. I would have made arrangements for another ticket had I known.
