I have no doubt that Smith is telling the truth, and his follow-up blog on this (everyone, please search it out - SilentBobspeaks) is a complete contradiction to this nonsense.
This has nothing to do with whether he "needed" two seats (No, he didn't), but a weird judgment made because someone else purchased two seats? (again, read his blog, because this worthless "apology" makes no mention of it).
